  1. WHAT IS PRIVACY POLICY ABOUT
    The Personal Data Protection Act 2010 (“PDPA”) was introduced to regulate the processing of Personal Data in commercial transactions. The PDPA, which applies to all companies that are established in Malaysia, requires us to inform you of your rights in respect of your Personal Data that is being processed or that is to be collected and further processed by us and the purposes for the data processing. The PDPA also requires us to obtain your consent to the processing of your Personal Data. Consequently, we want you to be clear how we are using your Personal Data and the ways in which you can protect your privacy. This Privacy Policy describes on what information is gathered, how this information is used and stored, who the information will be shared with, how you can opt out and how you can modify your Personal Data held by us and any other changes that have been made from time to time. This Privacy Policy applies to our Property.

“Content’means the content managed and/or provided by us and/or its content provider which includes without limitation all forms of text, graphics video, audio, files, data, images, photographs, pictures, logos, video clips, video streaming, news, live feeds and information on demand content.
“Contest”means giveaway or contest organised by us, our Affiliate and/or our agent.
“Law”means any law (whether domestic or international), statute, code, rule, guidelines, notices, ordinance, regulation, directive, order, judgment, writ, injunction or decree, and includes any changes in the application or interpretation thereof.
“Mobile App”means any mobile application made available by us in a digital distribution service that allows you to access and/or use our Services made available by us from time to time.
“Personal Data”means personal data as set out in Clause 5 of this Privacy Policy.
“PDPA”means Personal Data Protection Act 2010.
“Property”collectively means Services, Website, our Social Media and/or any other platforms (whether known now or in the future) owned and/or managed by us or our Affiliate.
“Post/Posted”means to publish, display, submit and/or upload.
“Services”collectively means the services and/or products provided through Mobile App, Website, Contest, and/or any other services made available by us from time to time.
“Social Media”means social media account such as Facebook, LinkedIn, Twitter, Instagram, Google, or any other social media.
“us, we, our”means Jayyid Land Sdn. Bhd. [Registration No. 201501023103 (1148432-A)] and/or any of our Affiliate.
“user, you, yours”means you, an individual, persons who is accessing and/or using our Property.
“Website”means www.gandinganjakel.com and/or any website owned and/or managed by us, and/or by our Affiliate, from time to time.
  1. PARENTAL ADVISORY
    We decided to make this entire paragraph BOLD to draw your attention. We are not able to contract with you unless you are 18 years old and above. If you are a child, please annoy pester your parent or guardian to obtain permission from them before using our Services. If you have any reason to believe that a child has provided Personal Data to us, please contact us and we will endeavor to delete that information from our database. Otherwise, we will deem that you are 18 years and above or has obtained consent from your parent or guardian when you provide your Personal Data to us.
  2. WHEN IS THIS PRIVACY POLICY APPLICABLE TO YOU
    The Privacy Policy is applicable to you the moment you access and/or use the Property.

    Throughout your dealings with us, you may be requested to furnish us the information including but not limited to the following to enable us to enter into transactions with you or to communicate with you on the Services and/or products related to our business:

    2. Contact details: home address, home phone number and mobile number, email address, work address, work number;
    3. Compensation information: such as amount, currency, bank account details, income tax file numbers, income range, introducer’s name, address and identity card number;
    4. Third Parties’ Information: your emergency contact person, tenant, authorised representatives, contractors, lawyers, and financiers; and
    5. Any such information as we deem necessary or appropriate from time to time in connection with your commercial relationship with us.

(collectively, “Personal Data”) as defined in PDPA. We have or will collect, record, hold, store, use, disclose and/or process (collectively referred to “Process”) any one or all of the Personal Data.

  1. PURPOSE OF PROCESSING PERSONAL DATA
    We Process and use the Personal Data you provide in a manner that is consistent with this Privacy Policy for one or more of the following purposes:
    1. the delivery of notices, services or products to you;
    2. in order for you to enter into the necessary agreement and/or contract to purchase the products and/or properties from us (for real estate customers only);
    3. user or customer relationship management procedures;
    4. those purposes specifically provided for in any particular service or product offered by us;

    11. conducting marketing and client profiling activities in connection with our services and related products;
    12. for research, benchmarking and statistical analysis purposes;
    13. post vacant possession delivery-related services, such as club house services, security and customer loyalty programmes;
    14. Business Transfer. As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets;
    15. We may also share your Personal Data with our Affiliate for purposes consistent with this Privacy Policy; and/or
    16. Authorised third party. Where services from such authorised third party is required, we will share your Personal Data on a strictly basis.

The above shall collectively be referred to as “Purpose” in this Privacy Policy.

    1. CONSEQUENCES OF REFUSAL OR FAILURE TO SUPPLY SUCH PERSONAL DATA

The refusal or failure to provide the Personal Data may result in the following:

    1. the inability of parties to formalize and/or carry out the relevant agreement or transaction in relation to the sale of our property, products and/or services;
    2. the inability for us provide you with the information, products and/or services requested; and/or
    3. the inability to provide you information about our products and/or services and obtaining your feedback on our products and/or services.

    Generally, we will keep the Personal Data provided to us as confidential. Nevertheless, you hereby consent and authorise us to provide and/or disclose your Personal Data with certain third parties which may be located within or outside Malaysia without further notice to you for the following purpose:
    1. any person to whom we are compelled or required to do so under law or in response to a legitimate instruction from a competent or government agency;
    2. pursuant to an order of a court of competent jurisdiction;

    We will take all reasonable steps to ensure your Personal Data is kept confidential, and to implement the appropriate administrative and security safeguards and procedure in accordance with relevant laws to prevent unauthorised or unlawful processing of your Personal Data and the accidental loss or damage of your Personal Data.

    Akta Perlindungan Data Peribadi 2010 (“APDP”) diperkenalkan untuk mengawal pemprosesan Data Peribadi dalam transaksi komersial. APDP yang terpakai kepada semua syarikat yang ditubuhkan di Malaysia, memerlukan kami untuk memberitahu anda tentang hak-hak anda berkenaan Data Peribadi anda yang sedang diproses atau yang akan dikumpulkan dan diproses selanjutnya oleh kami dan tujuan untuk pemprosesan data. APDP juga memerlukan kami untuk mendapatkan persetujuan anda untuk pemprosesan Data Peribadi anda. Oleh itu, kami ingin anda memahami cara kami menggunakan Data Peribadi anda dan cara-cara di mana anda boleh melindungi privasi anda.     “Aplikasi Mudah Alih”

    bermaksud aplikasi mudah alih yang disediakan oleh kami dalam perkhidmatan pengedaran digital yang membolehkan anda mengakses dan/atau mengunakan Perkhidmatan kami yang disediakan oleh kami dari semasa ke semasa.

    “Data Peribadi”

    bermaksud data peribadi seperti yang dinyatakan dalam Klausa 5 Dasar Privasi ini.

    “Gabungan”

    bermaksud seseorang atau organisasi yang mengawal kita, dikawal oleh kita, atau di bawah kawalan bersama seseorang atau organisasi yang mengawal kita. “Kawalan” bermaksud pemilikan saham ekuiti yang membawa lima puluh peratus (50%) atau lebih suara yang dapat dilaksanakan pada mesyuarat agung (atau yang setaraf dengannya).

    “Hantar/Hantarkan”bermaksud untuk menyiarkan, memaparkan, menghantar dan/atau memuat naik.
    “Harta”bermaksud secara kolektif Perkhidmatan, Laman Web, Laman Media Sosial kami dan/atau mana-mana platform lain (sama ada diketahui kini atau di masa depan) yang dimiliki dan/atau diuruskan oleh kami atau Gabungan kami.
    “kami”bermaksud Jayyid Land Sdn. Bhd. [No.  Pendaftaran: 201501023103 (1148432-A)] dan/atau mana-mana Gabungan kami.
    “Kandungan”bermaksud kandungan yang diuruskan dan/atau disediakan oleh kami dan/atau penyedia kandungan yang termasuk tanpa batasan semua bentuk teks, video grafik, audio, fail, data, imej, gambar, gambar, logo, klip video, streaming video, berita, suapan langsung dan maklumat mengenai kandungan permintaan.
    “Laman Media Sosial”bermaksud akaun media sosial seperti Facebook, LinkedIn, Twitter, Instagram, Google, atau mana-mana media sosial yang lain.
    “Laman Web”bermaksud www.gandinganjakel.com dan/atau mana-mana laman web yang dimiliki dan/atau diuruskan oleh kami, atau Gabungan kami, dari semasa ke semasa.
    “Perkhidmatan”bermaksud secara kolektif perkhidmatan dan/atau produk yang disediakan melalui Aplikasi Mudah Alih, Laman Web, Pertandingan dan/atau sebarang perkhidmatan lain yang disediakan oleh kami dari semasa ke semasa.,
    “pengguna, anda, milik anda”bermaksud anda, individu, orang yang mengakses dan/atau menggunakan Harta kami.
    “Pertandingan”bermaksud pemberian atau pertandingan yang dianjurkan oleh kami, Gabungan kami dan/atau ejen kami.
    “Pihak Berkuasa yang Berkenaan”bermaksud (i) kerajaan persekutuan Malaysia, (ii) mana-mana negeri, daerah, kota atau lain-lain bahagian politik Malaysia, (iii) mana-mana agensi, mana-mana mahkamah, tribunal, jabatan, biro, komisen atau lembaga, atau (iv) pihak berkuasa yang berkenaan di negara asing, jika berkenaan.
    “Undang-Undang”bermaksud mana-mana undang-undang (sama ada dalan negeri atau antarabangsa), statut, kod, peraturan, garis panduan, notis, peraturan, peraturan, arahan, perintah, penghakiman, writ, injunksi atau perintah, dan termasuk apa-apa perubahan dalam permohonan atau tafsirannya.

Jika anda seorang kanak-kanak, sila dapatkan ibu bapa atau penjaga anda untuk memberi kebenaran sebelum menggunakan Perkhidmatan kami. Sekiranya anda mempunyai alasan untuk mempercayai bahawa seorang kanak-kanak telah memberikan Data Peribadi kepada kami, sila hubungi kami dan kami akan cuba memadam maklumat tersebut dari pangkalan data kami. Jika tidak, kami akan menganggap bahawa anda berusia 18 tahun ke atas atau telah mendapat persetujuan daripada ibu bapa atau penjaga anda apabila anda memberikan Data Peribadi anda kepada kami.
  4. BILA DASAR PRIVASI INI TERTAKLUK KEPADA ANDA
    Dasar Privasi tertakluk kepada anda apabila anda mengakses dan/atau menggunakan Harta.
  5. PENGUMPULAN DAN PEMPROSESAN DATA PERIBADI
    Dalam perjalanan urusan anda dengan kami, anda mungkin diminta untuk membekalkan informasi termasuk tetapi tidak terhad kepada yang berikut supaya membolehkan kami untuk memasuki transaksi dengan anda atau menghubungi anda mengenai perkhidmatan dan/atau produk yang berkaitan dengan perniagaan kami :
    1. Data induk: nama, jantina, tarikh lahir, kewarganegaraan, status perkahwinan, kewarganegaraan, bangsa, asal etnik, kad pengenalan / maklumat pasport, kelayakan, pekerjaan, majikan, bekas majikan, gambar dan / atau gambar lain;
    2. Maklumat hubungan: alamat rumah, nombor telefon rumah dan nombor telefon bimbit, alamat e-mel, alamat kerja, nombor kerja;
    3. Maklumat pampasan: seperti jumlah, mata wang, butiran akaun bank, nombor fail cukai pendapatan, julat pendapatan, nama pengenalan, alamat dan nombor kad pengenalan;
    4. Maklumat pihak ketiga: orang hubungan kecemasan anda, penyewa, wakil yang diberi kuasa, kontraktor, peguam dan pemodal; dan
    5. Sebarang maklumat yang kami fikirkan perlu atau sesuai dari semasa ke semasa berkaitan dengan hubungan komersial anda dengan kami.

    (secara kolektif, “Data Peribadi”) sebagaimana didefinisikan dalam APDP. Kami mempunyai atau akan mengumpulkan, merekod, menyimpan, menyimpan, menggunakan, mendedahkan dan/atau memproses (secara kolektif disebut “Proses”) salah satu atau semua Data Peribadi.

  6. TUJUAN PENGUMPULAN DATA PERIBADI
    Kami akan Proses dan menggunakan Data Peribadi yang anda sediakan dengan cara yang selaras dengan Dsar Privasi ini. oleh kami untuk salah satu atau lebih daripada tujuan-tujuan berikut:
    1. penyampaian notis, perkhidmatan atau produk kepada anda;
    2. bagi membolehkan anda untuk memasuki perjanjian dan/atau kontrak berkaitan untuk membeli produk dan/atau hartanah daripada kami;
    3. penyelenggaraan dan penjagaan rekod dan perkembangan pelanggan;
    4. tujuan yang diperuntukkan dalam mana-mana perkhidmatan atau produk yang ditawarkan oleh kami atau rakan kongsi perniagaan kami;
    5. penilaian kredit, siasatan kewangan dan latar belakang apabila dianggap perlu;
    6. penyimpanan rekod dalaman kami;
    7. kutipan pembayaran tertunggak dari pelanggan dan / atau pelanggan;
    8. pencegahan jenayah (termasuk tetapi tidak terhad kepada frod dan pengubahan wang haram);
    9. mematuhi sebarang keperluan undang-undang atau peraturan berkaitan dengan provisi perkhidmatan dan produk kami dan membuat pendedahan di bawah keperluan sebarang undang-undang, peraturan, arahan, perintah mahkamah, undang-undang kecil, garis panduan, pekeliling dan kod yang terpakai kepada kami atau mana-mana anak syarikat dalam kumpulan kami;
    10. pemilikan kosong, penyerahan kunci, pengurusan harta/estet, perkhidmatan pelanggan dan/atau kerja-kerja rektifikasi kerosakan;
    11. menjalankan aktiviti pemasaran dan profil pelanggan berkaitan dengan perkhidmatan kami dan produk yang berkaitan;
    12. untuk tujuan penyelidikan, penanda aras dan analisis statistik;
    13. perkhidmatan selepas pemilikan kosong seperti perkhidmatan rumah kelab, sekuriti dan program ganjaran kesetiaan pelanggan;
    14. Pemindahan Perniagaan. Semasa kami mengembangkan perniagaan kami, kami mungkin menjual atau membeli perniagaan atau aset. Sekiranya penjualan korporat, penggabungan, penyusunan semula, pembubaran atau peristiwa serupa berlaku, Data Peribadi mungkin menjadi sebahagian daripada aset yang dipindahkan;
    15. Gabungan. Kami juga mungkin berkongsi Data Peribadi anda dengan Gabungan kami untuk tujuan yang selaras dengan Dasar Privasi ini; dan/atau
    16. Pihak ketiga yang Dibenarkan. Jika perkhidmatan daripada pihak ketiga yang Dibenarkan diperlukan, kami akan berkongsi Data Peribadi anda secara rahsia.

    Yang di atas secara kolektifnya dirujuk sebagai “Tujuan” dalam Dasar Privasi ini.

  7. AKIBAT KEENGGANAN ATAU KEGAGALAN UNTUK MEMBEKAL DATA PERIBADI
    Keengganan atau kegagalan untuk membekalkan Data Peribadi boleh menyebabkan yang berikut:
    1. ketidakupayaan pihak-pihak untuk merasmikan dan/atau menjalankan perjanjian atau transaksi yang berkenaan, mengenai penjualan hartanah, produk dan/atau perkhidmatan kami;
    2. ketidakupayaan kami untuk membekalkan anda dengan maklumat, produk dan/atau perkhidmatan yang diminta; dan/atau
    3. ketidakupayaan untuk membekalkan anda dengan maklumat mengenai produk dan/atau perkhidmatan kami dan mendapatkan maklum balas anda mengenai produk dan/atau perkhidmatan kami.
  8. PENDEDAHAN DATA PERIBADI
    Secara umumnya, kami akan menyimpan Data Peribadi yang dibekalkan kepada kami secara sulit. Walaubagaimanapun, anda bersetuju dengan pendedahan Data Peribadi berikut oleh kami kepada kumpulan-kumpulan pihak ketiga berikut yang mungkin terletak di dalam ataupun di luar Malaysia utanpa memberi notis selanjutnya kepada anda untuk sebab-sebab yang berkaitan dengan tujuan berikut:
    1. mana-mana orang yang kami terpaksa atau diminta untuk melakukannya di bawah undang-undang atau sebagai tindak balas kepada arahan yang sah dari agensi yang berwenang atau kerajaan;
    2. menurut perintah mahkamah yang mempunyai bidang kuasa yang kompeten;
    3. mana-mana syarikat dan anak syarikat yang berkaitan, termasuk-yang ditubuhkan pada masa akan datang. Kami akan memastikan bahawa akses ke Data Peribadi anda terhad kepada staf yang secara kontrak diminta untuk memproses Data Peribadi anda sesuai dengan keperluan pekerjaan masing-masing dan hanya maklumat yang diperlukan yang dilepaskan kepada pekerja yang berkenaan;
    4. jika berkenaan, pihak ketiga yang menyediakan perkhidmatan atau produk berkaitan dengan perniagaan kami;
    5. agensi kerajaan, pihak berkuasa berkanun dan pengawal selia industri;
    6. juruaudit, perunding, akauntan, peguam atau penasihat kewangan atau profesional kami yang lain;
    7. subkontraktor kami atau penyedia perkhidmatan atau produk pihak ketiga sebagaimana yang ditentukan perlu atau sesuai;
    8. syarikat / entiti pengurusan harta pihak ketiga berkenaan dengan pengurusan harta tanah yang telah dibeli oleh pelanggan; dan / atau
    9. penyedia perkhidmatan kami yang dilantik berhubung dengan program kesetiaan kami, untuk tujuan penyerahan penebusan hadiah dan perkhidmatan.
  9. PERLINDUNGAN DATA PERIBADI
    Kami akan mengambil semua langkah yang munasabah untuk memastikan Data Peribadi anda dirahsiakan, dan untuk melaksanakan keselamatan dan prosedur pentadbiran dan keselamatan yang sesuai dengan undang-undang yang berkaitan untuk mencegah pemprosesan Data Peribadi anda yang tidak sah atau tidak sah dan kehilangan atau kerosakan Data Peribadi anda secara tidak sengaja.
  10. PERSETUJUAN PIHAK KETIGA
    Sekiranya anda telah membekalkan data peribadi pihak ketiga (contohnya, orang hubungan kecemasan anda, penyewa, wakil-wakil yang diberikan kuasa, kontraktor, peguam, ahli kewangan) kepada kami, kami bergantung kepada anda untuk memperoleh dengan secukupnya terlebih dahulu persetujuan pihak ketiga tersebut untuk membolehkan kami untuk memproses data peribadi mereka berkenaan Tujuan tersebut.
  11. HAK UNTUK MENGAKSES DAN MEMBUAT PEMINDAAN
    Anda mempunyai hak untuk meminta akses untuk dan jika diperlukan, membetulkan sebarang Data Peribadi anda dalam rekod kami. Anda mempunyai hak untuk:
    1. periksa sama ada kami menyimpan atau menggunakan Data Peribadi anda dan meminta akses ke data tersebut;
    2. meminta pembetulan Data Peribadi anda dalam rekod kami sekiranya maklumat tersebut adalah tidak tepat, tidak dikemaskini atau tidak lengkap;
    3. meminta agar Data Peribadi anda disimpan oleh kami hanya selama diperlukan untuk memenuhi tujuan yang dikumpulkannya;
    4. meminta bukti polisi dan prosedur berkenaan perlindungan dan jaminan Data Peribadi anda dalam rekod kami;
    5. memaklumkan kepada kami bantahan anda terhadap penggunaan Data Peribadi anda untuk matlamat pemasaran; dan
    6. menarik balik, sepenuhnya atau sebahagiannya, kebenaran yang diberi sebelum ini, dalam setiap kes tertakluk kepada apa-apa sekatan perundangan, syarat-syarat kontrak dan tempoh masa yang munasabah.

    Anda boleh meminta akses, mengkaji, meminda dan/atau membetul Data Peribadi atau sebarang soalan berkaitan Harta atau Data Peribadi anda melalui:

  12. BAHASA
    Sekiranya berlaku sebarang terma-terma yang tidak berkonsisten, versi Bahasa Inggeris Polisi ini akan digunapakai.

  13. PERUBAHAN
    Kami mungkin mengubah dan/atau meminda Dasar Privasi dari semasa ke semasa. Kami akan memuat naik semua perubahan pada notis ini di Laman Web kami dan / atau dengan cara komunikasi lain yang dianggap sesuai oleh kami. Oleh itu, sila lihat Dasar Privasi kami dari semasa ke semasa, terutamanya sebelum anda memberikan kami apa-apa Data Peribadi anda. Kali terakhir Dasar Privasi ini dikemaskini adalah pada tarikh yang dinyatakan di atas. Sekiranya anda terus menggunakan Hartanah selepas perubahan, pindaan atau pengubahsuaian kepada Dasar Privasi, ini menandakan persetujuan anda kepada syarat-syarat Dasar Privasi yang telah dipinda.
